Abstract:
The right to retention as unconventional security must comply with some legal requirements, which are the following: a) Possession of a thing, in good faith. (b) A claim in favour of the holder and borne by the person claiming restitution of the thing. (c) Connection between the receivable and the thing. d) That said thing would not have to be delivered before the credit is due. The possibility of exercising the right to retention arises from the principle of the universal guarantee of the patrimony, and it is applied, among other cases, when the creditor is not paid for work done on a movable thing. The Code of Legal, Moral and Ethical Duties of the Professional in Law contains Rule 47, which may be illegal, because in my opinion, it leaves the principles and foundations of the commented figure without content by departing from them, which is inappropriate, because the promulgation of a regulation does not have the power to disregard and displace the normative, doctrinal, and jurisprudential elaborations that have evolved so much since the Roman Law.
